How we evaluate your legal issues

 

Every legal matter is different and has many moving parts. Some of the questions we will answer together will include these basics that will help us determine how to move forward.

 

Establishing jurisdiction

  • Does the court have the power to decide the case?
  • Has it been filed in the proper court?
  • Is there an arbitration clause or other contractual provision that removes the dispute from the normal system?

 

Establishing venue

  • Is the suit filed in the proper place?  Or has it been filed in an improper or inconvenient place?
  • Is there a choice-of-venue or other contractual provision that requires the parties to resolve their disputes in a certain place?

 

Establishing standing

  • Did the defendant’s wrong (if proven) harm the plaintiff?  Or did the harm/wrong actually accrue to someone else?
  • Can the plaintiff herself/himself establish that they’re the right person to bring the claim.

 

Establishing timeliness

  • Did the plaintiff bring the claim in the appropriate time frame?  Or is it barred by a statute of limitations, or a statute of repose?
  • Even if the statute of limitations or the statute of repose has run, can the plaintiff still prove timeliness through the defendant’s deceit and deception?  Or through the inherent difficulty in knowing about the harm (sometimes called the “discovery rule”)?

 

Establishing liability

  • Can the plaintiff prove that the defendant violated some legal wrong?  Or did the defendant simply violate a “moral” code?  But how?  When?  Where?
  • Does this case fit within the law’s continual redefinitions of what constitutes the relevant “wrong” (e.g., breach of a fiduciary duty, etc.)?

 

Establishing damages

  • Can the plaintiff prove that the defendant’s legal wrong caused damages?  Or are the damages too uncertain, or speculative?
  • Does the plaintiff need to prove damages—or can damages be presumed (as in some defamation cases)?
